USA EB-5 Immigrant Investor Program

U.S. Green Card and Citizenship for investors.

The U.S. government created the EB-5 Immigrant Investor Program to encourage foreign investment in U.S. businesses. In exchange for investing in a business that creates jobs for U.S. workers, high net-worth non-U.S. nationals and their families are eligible to become permanent residents of the United States.  Put simply, EB-5 is a U.S. Immigrant Investor Program, created by congress in 1990 that allows a foreign high net-worth investor to obtain a Green Card and eventually, U.S. Citizenship.

While the program has evolved considerably since its creation in 1990, there are currently two ways for foreign investors to obtain an EB-5 visa:

1. Direct investment in a new or existing commercial enterprise that creates jobs, or 
2. Investing capital through a “Regional Center”, a government-approved business entity that actively manages investor funds and the immigration approval process

The basic program requirements include: 

  • A minimum capital investment of $1 million in a new or existing job-creating venture.
  • If the business receiving capital is located in a Targeted Employment Area (TEA) – defined as a rural area or a region with high unemployment – the minimum investment amount is reduced to $500,000.
  • Creation of 10 new jobs


The permanent residence obtained by the investor is conditional for two years and can be made permanent upon satisfying USCIS at the end of the two years that the investment proceeds have not been withdrawn and the requisite jobs have been created.

  • After 5 years from receiving your temporary green card, you are eligible for U.S. Citizenship

Obtaining Your Green Card: Timeline

Through the EB-5 Program, an investor and his family can expect the following timeline after initial investment deposit:

  • 12 Months: Within 12 months of the investors deposit, and once the I-526 is approved, investor and his family will receive Temporary Green Cards
  • After 2 Years: File I-829, and, if approved, investor and family will get their Permanent Green Cards
  • After 5 Years: Investor and family will be eligible for U.S. Citizenship

Reduced University Tuition

One of the main benefits of obtaining lawful permanent residency within the United States is that you and your immediate family will be able to attend any university in the United States and pay tuition fees the same as any United States resident, not as an international student. As shown in Figure 1, below, obtaining United States residency results in an average saving of $104,961 per person enrolled in a university that is located within the state in which they reside. These savings are underestimated substantially because they do not take into consideration graduate education including legal and visa fees. A family with four children enrolled into university that they reside in would save at least $420,000 only for their under-graduate tuition fees depending on the university that their children are enroll in.  Again it is paramount to highlight that these savings do not include legal and visa fee savings as well do not include graduate degree tuition savings.

The Regional Center Program, administered by US Citizenship and Immigration Services (USCIS), directs foreign investment into areas with high unemployment rates, or which otherwise qualify in targeted enterprise zones (TEA), in order to stimulate economic growth and revitalize underdeveloped local economies.

A Regional Center is any economic entity which has been designated by USCIS to be involved with the promotion of economic growth, improved regional productivity, job creation, and increased domestic capital investment.  Regional Centers can be public or private entities, comprise entire cities or districts, and have very specific or very broad investment efforts. 

Benefits of Investing through a Regional Center

Investors who contribute $1,000,000 and create at least 10 full-time jobs, whether directly or indirectly, are eligible for permanent resident status. The minimum required investment is reduced to $500,000 when investing in a designated Regional Center. Furthermore, investments made through Regional Centers can take advantage of a more expansive calculation of job creation including direct, indirect and induced jobs.
